Terms of Service

1. Acceptance of Terms

By accessing or using PointPlus POS ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.

2. Service Description

PointPlus POS provides a cloud-based point-of-sale system including:

  • In-store POS terminal software
  • Online storefront creation and management
  • Inventory management and synchronization
  • Payment processing through third-party providers
  • Reporting and analytics tools
  • Optional add-on modules

3. Account Registration

To use our Service, you must:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Be at least 18 years old or the age of majority in your jurisdiction
  • Have the authority to bind your business to these terms

4. Subscription and Payment

Trial Period: New merchants receive a 30-day free trial with basic features. During signup, you will be asked to provide a payment method. Your payment method will not be charged during the trial period.

Automatic Billing: If you provide a payment method during signup, it will be automatically charged for your selected plan starting 30 days after your trial begins. You may cancel your subscription at any time before the trial period ends to avoid charges. If you do not provide a payment method during signup, you may add one later through your account settings.

Paid Plans:

  • Standard Plan: $189/month or $1,890/year (17% savings)
  • Enterprise Plan: $299/month or $2,990/year (17% savings)
  • Add-on modules available at additional cost

Billing: Subscriptions renew automatically on a monthly or annual basis depending on your selection. You may cancel at any time through your account settings. Cancellations are effective at the end of your current billing period. No refunds for partial months or years.

Payment Method Storage: Payment methods are securely stored by PayPal. We do not store your credit card information on our servers. You authorize us to charge your stored payment method for your subscription fees and any additional services you purchase.

5. Payment Processing

Payment processing is provided by Valor PayTech. By using our payment features, you agree to:

  • Comply with Valor PayTech's terms and conditions
  • Pay applicable transaction fees
  • Maintain PCI compliance standards
  • Accept responsibility for chargebacks and disputes

6. Acceptable Use

You agree NOT to:

  • Use the Service for illegal purposes
  • Sell prohibited items (weapons, illegal drugs, etc.)
  • Engage in fraudulent transactions
  • Violate any laws or regulations
  • Attempt to breach security or access unauthorized data
  • Resell or redistribute the Service without permission

7. Data Ownership and Backup

You retain ownership of all data you enter into the Service. We recommend regular data exports. While we maintain backups, you are responsible for maintaining your own copies of critical data.

8. Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted service. Scheduled maintenance will be announced in advance. We are not liable for losses due to service interruptions.

9. Termination

Either party may terminate the agreement at any time. Upon termination:

  • Your access to the Service will be suspended
  • You have 30 days to export your data
  • No refunds for prepaid periods
  • We may delete your data after 90 days

10. Limitation of Liability

PointPlus POS is provided "as is" without warranties. We are not liable for:

  • Lost profits or business opportunities
  • Data loss or corruption
  • Third-party actions (payment processors, customers, etc.)
  • Indirect, incidental, or consequential damages

Our total liability shall not exceed the amount you paid in the past 12 months.

11. Modifications

We may modify these terms at any time. Continued use of the Service after changes constitutes acceptance. Material changes will be communicated via email.
